Reasonable Modification Requests

The Town of Acton (Acton) and its third-party vendors have a commitment to providing equitable transportation for all individuals. If you require a reasonable modification on any of Acton’s transportation services, please inform the driver of your requirements upon entering the van. You may also contact dispatch at (978) 844-6809 to request a reasonable modification prior to your trip. 

You are not required to disclose any disability status to the driver aside from requesting your desired modification. A reasonable accommodation is a change or exception to a policy, practice or procedure that allows individuals with disabilities to have equal access to programs, services and activities. 

Acton will make reasonable modifications to policies, practices and procedures when necessary to ensure access to transit services persons with disabilities, unless:

  • Making the modification would fundamentally alter the nature of the public transportation service;
  • Making the modification would create a direct threat to the health and safety of other passengers;
  • The individual with a disability is able to fully use Acton’s transit service without the modification being made; or
  • Making the modification creates an undue financial burden on the transit system.

Time Frame for Processing Requests to Provide Reasonable Modification 

Acton will review requests for reasonable modifications and then provide such modifications, where appropriate, in as short of a time frame as reasonably possible. Acton recognizes however, that the time necessary to review a request will depend on the nature of the modification(s) requested and whether it is necessary to obtain supporting information. 

Granting a Reasonable Modification Request

As soon as Acton determines that a reasonable modification will be provided, that decision shall be immediately communicated to the individual in whatever format is required by the requester. All requests and responses shall be memorialized in a written log. 

When deciding on changes to transit services, Acton will prioritize options that provide services, programs, and activities to qualified people with disabilities in the most inclusive and suitable setting based on their needs.

Denial of Reasonable Modification Request

As soon as Acton determines that a request for reasonable modification will be denied, Acton will communicate the basis for the decision in writing to the individual requesting the modification. The explanation for the denial will clearly state the following:

  • The specific reason for the denial;
  • Any alternative modification that may create the same access to transit services as requested by the individual; and
  • The opportunity to file a complaint relative to Acton’s decision on the request.
